SA - 474588, as data controller, is committed to protecting the privacy of its users in accordance with Regulation (EU) 679/2016 (hereinafter referred to as the “Regulation”) and to ensuring protection also for individuals to whom such legislation is not specifically applicable. This privacy policy (“Privacy Policy”) applies solely to this website and any other website or service controlled by the Company where this Privacy Policy is published or referenced (hereinafter collectively referred to as the “Site”). Please read this Privacy Policy carefully before using the Site.

  1. The Site

The main purpose of the website www.hydromarinetech.it is to present the Company’s services and products. This Privacy Policy describes how we collect, use, and share personal data obtained through users’ use of the Site. The Company reserves the right to add or remove functionalities from the Site and to modify the services and/or products offered at any time, and the Privacy Policy may be updated by the Company at any time, with notification of any changes given to users and visitors of the Site. As the Site may allow access to websites operated by third parties, please note that this Privacy Policy does not apply to such third-party websites, and the Company is not responsible for the protection of personal data by those third parties.

  1. Processed data

Data voluntarily provided by the user 

The Company generally receives and collects personal data voluntarily provided by the user in relation to the functionalities offered through the Site: 

  • Contact form: name, surname, email, phone number (if provided), and the content of the user’s request;
  • Newsletter: email address for subscription and receipt of promotional and informational communications.

Legal entities who, as users of the Platform, provide personal data of third parties must ensure that the communication of such data to the Company and our subsequent processing for the purposes specified in this Privacy Policy are in compliance with applicable law. For example, before providing us with third-party personal data, the user must inform them and obtain their consent to the processing, if required by applicable legislation. All obligations in this regard are the sole responsibility of the user, who will act as an independent data controller. 

Browsing data 

Browsing data includes all data automatically collected through the Site, such as the types of actions performed on the Site by the user and how the user is using the Site. We may also automatically record the IP address (i.e., the unique address identifying the user's device on the internet), which is automatically recognized by our server. Browsing data is used solely to obtain anonymous statistical information on the use of the Site and to check its correct functioning, and is deleted immediately after processing. Such data may also be used to determine liability in the event of possible cybercrimes against the Site or to protect our rights.

Sending newsletters and promotional communications. The Company processes users' personal data to send promotional information regarding the Company's services and/or products and to send invitations to Company events (e.g., newsletters).

The Company processes users’ personal data for these purposes only with the user’s prior consent.

Legal obligations. The Company processes users’ personal data to comply with obligations arising from laws, regulations, or EU legislation.

 

The Company processes the data for these purposes to fulfill a legal obligation. 

  1. Nature of Data Provision and Consequences of Refusal

Providing data for the purposes under point 3.A is necessary to fulfill the information request via the contact form. A refusal by the user would prevent the Company from fulfilling its contractual obligations and from providing the requested features, services, and information. Providing data for the purposes under point 3.B is optional, and any refusal by the user will not affect the delivery of the requested services, features, or information through the Site. The Data Controller does not use automated decision-making processes, including profiling. 

  1. Data Recipients

Users' data is essential for providing our services, and the Data Controller does not sell personal data to third parties. 

Third-party service providers: We share users' personal data with third-party service providers who act as data processors to enable use of the Site and/or to receive services via the Site. These third parties may include professionals (even as part of an association) providing technical, commercial, or administrative consulting services to the Company; companies managing or maintaining the IT infrastructure underlying the Site; email marketing service providers; and agencies specialized in promotional and marketing services on behalf of the Company.

Third parties to comply with legal obligations or protect Company rights: Personal data may be disclosed to institutions, law enforcement, judicial, administrative, regulatory, or public safety authorities in the context of legal or administrative proceedings or to comply with a legal obligation or protect our rights, including in court.

Third parties in corporate transactions: Personal data may be shared in connection with corporate events such as mergers, business transfers (or a business unit), or other extraordinary transactions, during which the Company may need to share information with potential buyers, counterparties, and their advisors.

  1. Data of Minors

The Company does not knowingly collect or retain personal data of individuals under the age of 18, nor does it knowingly allow such minors to use the Site. 

  1. International Data Transfers

The Company processes data exclusively through servers located in Italy or in EU countries subject to Regulation (EU) 679/2016 and does not transfer users' personal data outside the EU. Before transferring data outside the European Union, users will be informed and the Company will adopt appropriate safeguards, including contractual ones, as required by applicable privacy legislation to ensure the protection, security, and confidentiality of the personal data transferred (e.g., by adopting the European Commission’s Standard Contractual Clauses) or verify that the recipient, if located in the United States, is duly enrolled in the "Privacy Shield" program.

  1. Data Retention Period

We retain users’ personal data only for as long as necessary to provide services or achieve the purposes for which the data was collected, or to comply with legal obligations (e.g., tax, accounting purposes). If we have collected personal data based on the user's consent and no longer have a valid legal basis to continue processing it, we will delete the data concerned if the user subsequently withdraws consent. Notwithstanding the above, we retain personal data collected in accordance with this Privacy Policy for marketing purposes (point 3.B) for no more than 2 years from collection. After this period, the data will be deleted or anonymized.

This site uses technical, analytical, and third-party profiling cookies to improve the browsing experience and offer content in line with user preferences. The user may exercise the following rights regarding their personal data:

Right to rectification and completion: The data subject has the right to obtain the rectification of inaccurate personal data without undue delay and to have incomplete personal data completed, including by providing a supplementary statement.

Right to erasure: The data subject has the right to obtain the deletion of personal data without undue delay.

Right to object: The data subject has the right to object at any time, for reasons related to their particular situation, to the processing of personal data based on the data controller’s legitimate interest.

Right to restrict processing: The data subject has the right to request that processing be limited to specific types of data, for a limited duration, or in limited ways.

Right to data portability: The data subject has the right to receive their personal data in a structured, commonly used, and machine-readable format and to transmit those data to another controller without hindrance.

Right to lodge a complaint: Without prejudice to any other administrative or judicial remedy, the data subject who believes that processing of their personal data violates the Regulation has the right to lodge a complaint with a supervisory authority, particularly in the member state where they habitually reside or work or where the alleged violation occurred. The supervisory authority will inform the complainant of the outcome of the complaint, including the possibility of a judicial remedy.
